This is an appeal from a conviction for armed robbery. Kimble contends that the indictment by which he was charged should have been dismissed as duplicitous; that the victims identification of him should have been suppressed as the product of tainted pretrial contacts; that an identification of his photograph should have been suppressed because counsel was not present at the photo display; that it was error for the trial Judge to refuse to call additional veniremen when none of the venire was of the same race as Kimble; and that it was a denial of due process to allow the jury to deliberate almost twenty-four hours without access to rest facilities. We shall address each of these points in turn.
